Contracts of Employment

A contract of employment is a legally binding agreement between an employer and an employee. It may be oral or in writing. It is best practice to have written contracts and most employers do.

Certain particulars must be put into writing within two months of the start of the contract. This document is known as a written statement of employment particulars and sets out the most important aspects of the contract of employment. All employers, regardless of size, must provide this. Failure to provide one may lead to an employee applying to an Employment Tribunal. It may determine what the contents of the statement should be and the Tribunal may award compensation.
